There is an OOB before business rule, is in place on the Incident table, runs when there is a query on the Incident table. As per this rule, the records are restricted for the non- itil users
The above is the expected behaviour of the ServiceNow platform. If the behaviour needs to be changed, Go to the System Definition >Business Rule -> Incident query and change the logic according to the business needs.
